Donovan Waters, K.C., F.R.S.C. #

With the death of Dr. Waters, the legal community has lost a leading international expert in trust law and the author of several texts including Law of Trusts in Canada. He had a distinguished career, first as an academic (including positions at the Universities of Oxford, London, Chicago, Saskatchewan, Montreal and Victoria) and, after his retirement from academia, in private practice for almost 30 years.

In private practice, Dr. Waters acted as counsel in relation to the establishment, operation and regulation of a variety of domestic and offshore trust structures created for private and commercial purposes. His diverse practice experience included mutual fund and other pooled investment trusts, land and mortgage syndication trusts, land reclamation trusts, First Nations trusts, trusts created for active business and business succession purposes, charitable trusts, pension plans and all manner of estate planning related structures in wills and family trusts.

Dr. Waters received two honorary degrees, a D.C.L. from Oxford, and a STEP Lifetime Achievement Award for his work in trust law. In addition to two hundred or more articles, his most significant book as Law of Trusts in Canada, published by Carswell, Toronto, in 1974, and now with two assistant editors in its 5th edition. It has been widely cited in the courts.
